These Terms & Conditions and Cancellations (“Terms”) apply to all excursions, boat tours, snorkeling activities, whale-watching tours, private charters, reservations, and related services offered by Maui Express LLC dba Maui Adventure Cruises (“Maui Adventure Cruises,” “MAC,” “we,” “us,” or “our”).

By accessing our website, making a reservation, or participating in any Maui Adventure Cruises activity, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms or our Privacy Policy, please do not use our website or services.

Reservations and Booking

Reservations are subject to availability and are not confirmed until accepted through our authorized booking system or directly by Maui Adventure Cruises.

Maui Adventure Cruises offers a variety of ocean activities, including:

  • Lanai Dolphin and Snorkel Adventures
  • Coastline Snorkel Adventures
  • Whale Watch Adventures
  • Whale Season Passes
  • Private Charters
  • Other related ocean excursions

Tour availability, pricing, departure times, destinations, vessel assignments, and inclusions are subject to the information provided at the time of booking.

Guests are responsible for reviewing their reservation confirmation and contacting Maui Adventure Cruises promptly if any reservation information is incorrect.

Payment

Payment is required in accordance with the terms presented during the booking process.

Prices may be subject to applicable taxes, fees, transportation charges, or other charges disclosed during the reservation process.

Where payment is processed through a third-party payment provider, additional terms and privacy policies may apply.

Cancellation Policy

A 48-hour cancellation notice before the scheduled trip departure time is required for a refund.

Cancellations received less than 48 hours before the scheduled departure time are generally not eligible for a refund.

Cancellation requests should be made as soon as possible and should include the reservation name, scheduled trip date, and confirmation information.

The cancellation policy applies to individual excursions unless different terms are specifically stated in the reservation confirmation.

Medical Cancellations

If a guest attempts to cancel less than 48 hours before the scheduled departure because of a medical illness, Maui Adventure Cruises may consider the cancellation for a refund.

A written statement from a local physician or medical clinic may be required to document the medical condition.

Medical cancellations are subject to review and do not automatically guarantee a refund.

Rescheduling

A guest may reschedule an excursion without a cancellation charge if the new excursion is taken within 72 hours of the originally booked excursion, subject to availability.

If space is unavailable for the requested replacement excursion, Maui Adventure Cruises may be unable to accommodate the requested change.

Any difference between the price of the originally booked excursion and the rescheduled excursion will be paid by or refunded to the passenger, as applicable.

Rescheduling requests should be made as soon as possible.

No-Shows

Guests who fail to appear for their scheduled excursion may be treated as a no-show.

No refunds are generally provided for no-shows.

A no-show may include:

  • Failure to arrive at the designated departure location
  • Failure to arrive in sufficient time to board
  • Failure to respond to reasonable attempts to contact the guest
  • Providing incorrect or incomplete reservation information
  • Voluntarily choosing not to participate after the scheduled departure time

Guests are responsible for allowing sufficient time to reach the departure location.

Late Arrivals

Guests are responsible for arriving at the designated check-in and departure location on time.

The vessel may be required to depart according to a fixed schedule.

If a guest arrives after the scheduled departure and the vessel has already departed, the reservation may be treated as a no-show.

A refund is not guaranteed for late arrivals.

Changes to Reservations

Requests to change the date, time, number of guests, excursion, or other reservation details should be made as early as possible.

Changes are subject to availability and applicable cancellation or pricing terms.

A requested change is not confirmed until Maui Adventure Cruises has approved it.

Additional charges may apply if the new reservation has a higher price.

If the replacement reservation has a lower price, any applicable difference may be refunded in accordance with the reservation terms.

Weather, Ocean, and Wind Conditions

Maui Adventure Cruises operates on the ocean, and weather and sea conditions can change quickly.

Trip destinations and activities are subject to:

  • Weather conditions
  • Wind conditions
  • Ocean conditions
  • Wave conditions
  • Visibility
  • Marine conditions
  • Harbor conditions
  • Safety requirements
  • Government restrictions
  • Other circumstances affecting safe operation

The Captain has final authority regarding whether a trip can safely operate and which destination or snorkel location is appropriate.

A particular snorkel site or destination is not guaranteed.

The Captain may select or change a snorkel location based on visibility, ocean conditions, weather, safety, and other operational considerations.

Cancellation by Maui Adventure Cruises

Maui Adventure Cruises may delay, modify, reschedule, or cancel an excursion when weather, ocean conditions, wind, safety concerns, vessel conditions, government restrictions, or other circumstances make the trip unsafe or impractical.

When a trip is canceled by Maui Adventure Cruises before departure, the company may offer the opportunity to reschedule the excursion for another available date.

If the excursion cannot reasonably be rescheduled, Maui Adventure Cruises may provide a refund in accordance with the circumstances of the cancellation and the applicable reservation terms.

A cancellation or itinerary change made for safety reasons does not constitute a breach of these Terms.

Changes During a Trip

Weather and ocean conditions may change after a vessel has departed.

The Captain may:

  • Change the route
  • Change the destination
  • Change the snorkeling location
  • Shorten the excursion
  • Return to harbor early
  • Suspend an in-water activity
  • Cancel a particular activity
  • Take other reasonable action necessary for passenger and crew safety

Safety decisions are made by the Captain and crew and are final.

No particular destination, wildlife encounter, snorkel site, or ocean condition is guaranteed.

Whale Watching

Whale Watch Adventures are conducted subject to seasonal availability and applicable wildlife regulations.

Maui Adventure Cruises does not guarantee the presence, location, behavior, or duration of whale sightings except where a specific whale-sighting guarantee is expressly stated for the applicable excursion.

During the applicable whale season, Maui Adventure Cruises may offer a whale-sighting guarantee or next-trip accommodation as described on the booking page or applicable tour description.

Wild animals are unpredictable, and sightings cannot otherwise be guaranteed.

Guests must comply with all applicable federal and state laws and instructions concerning marine wildlife.

Dolphin and Wildlife Sightings

Dolphins, whales, sea turtles, rays, fish, and other marine animals are wild animals.

Maui Adventure Cruises cannot guarantee that guests will see a particular species or a particular number of animals.

The behavior and location of marine wildlife are outside the company’s control.

Guests must follow all instructions from the Captain and crew concerning appropriate distances, interactions, and wildlife protection.

Snorkeling and In-Water Activities

Snorkeling and other in-water activities are subject to weather, ocean conditions, visibility, safety, and the Captain’s determination.

Guests participating in an in-water activity must be competent swimmers unless otherwise approved by Maui Adventure Cruises.

Floatation devices, noodles, viewing boards, or life vests may be available depending on the excursion and conditions.

The availability of a particular flotation device is not guaranteed.

Guests must follow all instructions provided by the Captain and crew before entering the water and while participating in water activities.

Age Restrictions

Unless otherwise stated for a particular private charter, Maui Adventure Cruises’ standard excursions are generally not suitable for children under **5 years of age**.

Certain activities may have additional age or participation requirements.

Private charters may not have the same age restrictions, subject to the Captain’s approval and applicable safety requirements.

Parents and legal guardians are responsible for supervising minors.

No child may be left unattended by a parent or legal guardian during an excursion.

Pregnancy and Medical Restrictions

Due to the nature of boat travel and the physical conditions associated with ocean excursions, certain activities may not be suitable for:

  • Pregnant persons
  • Persons with recent back or neck surgery
  • Persons with recent major injuries
  • Persons with medical conditions that may be aggravated by boat movement or in-water activities

Guests are responsible for determining whether they are physically capable of participating.

Maui Adventure Cruises may refuse participation when the Captain or crew reasonably determines that participation would create a safety concern.

Guests should consult a qualified medical professional before participating if they have concerns about their ability to safely participate.

Assumption of Risk

Boat travel, snorkeling, swimming, and outdoor ocean activities involve inherent risks.

These risks may include, but are not limited to:

  • Rough or changing ocean conditions
  • Waves and vessel movement
  • Slippery or wet surfaces
  • Boarding and disembarking
  • Falls
  • Swimming and snorkeling
  • Water entry and exit
  • Marine wildlife
  • Fish, coral, or other marine organisms
  • Fishing or snorkeling equipment
  • Weather conditions
  • Sun exposure
  • Wind
  • Rain
  • Seasickness
  • Equipment failure
  • Perils of the sea
  • Acts or omissions of other participants
  • Other risks associated with ocean activities

Guests participate at their own risk and may be required to execute a release and waiver before participating.

Release and Waiver

Maui Adventure Cruises requires passengers and participants to review and accept its applicable **Swimming, Snorkeling, and Boat Passenger Release and Waiver**.

Acceptance of the waiver may be required before completing a reservation and payment.

Guests may also be required to confirm or execute the waiver again during check-in before boarding.

The waiver contains additional terms concerning risks, releases, and limitations of liability.

If a guest refuses to complete a required waiver, Maui Adventure Cruises may refuse participation.

Captain’s Authority

The Captain has final authority over the safe operation of the vessel and the activities conducted during an excursion.

The Captain may determine:

  • Whether the vessel departs
  • Whether the vessel returns to harbor
  • The route taken
  • The destination
  • The snorkeling location
  • Whether guests may enter the water
  • Whether an activity must be suspended
  • Whether weather or ocean conditions require an itinerary change

Guests must follow all reasonable instructions given by the Captain and crew.

Guest Responsibilities

Guests are responsible for:

  • Arriving at the designated departure location on time
  • Providing accurate reservation information
  • Following all safety instructions
  • Following instructions from the Captain and crew
  • Using equipment properly
  • Supervising children
  • Disclosing relevant safety or accessibility concerns
  • Acting respectfully toward crew members and other passengers
  • Complying with applicable laws and regulations

Maui Adventure Cruises may refuse participation or remove a guest from an excursion if the guest behaves in a dangerous, threatening, abusive, disruptive, or unlawful manner.

No refund is guaranteed when participation is refused or terminated because of unsafe or inappropriate behavior.

Personal Belongings

Guests are solely responsible for their personal possessions.

This includes:

  • Clothing
  • Hats
  • Cameras
  • Cell phones
  • Sunglasses
  • Electronic devices
  • Other personal property

Maui Adventure Cruises does not provide guaranteed waterproof or dry storage for personal electronics.

Guests should bring their own appropriate waterproof or resealable bags when carrying cameras, phones, or other electronic devices.

Maui Adventure Cruises is not responsible for damage to electronic devices or other personal property brought aboard the vessel, except where liability cannot legally be excluded.

Alcohol

Alcohol consumption on private charters is subject to applicable law, vessel rules, and the instructions of the Captain.

For private charters, guests may bring their own beverages where permitted, but glass containers are not permitted.

Alcohol may be consumed only when permitted by the Captain and should not be consumed before or during snorkeling or other in-water activities where doing so would create a safety concern.

The Captain may prohibit or restrict alcohol consumption at any time for safety reasons.

Smoking

Smoking is not permitted aboard the vessel or at the dock where prohibited by applicable state or local law.

Guests must comply with all applicable smoking restrictions.

Environmental and Wildlife Protection

Guests must not intentionally damage coral, harass marine animals, remove protected marine life, or otherwise violate applicable environmental or wildlife regulations.

Guests must follow all instructions regarding responsible wildlife viewing and snorkeling.

Maui Adventure Cruises reserves the right to terminate participation if a guest intentionally violates applicable environmental or wildlife regulations.

Private Charters

Private charters provide the vessel for the exclusive use of the private group during the booked period.

Private charters may be customized based on the group’s requested activities and destination, subject to weather, ocean conditions, vessel capabilities, safety requirements, and Captain approval.

Private charters generally have a minimum duration as stated during the booking process.

Additional hours, catering, or other optional services may be subject to additional charges.

Private charter requests are subject to availability and confirmation.

Charter Duration

The scheduled duration of an excursion begins and ends according to the departure and return times provided during booking.

Actual duration may vary because of:

  • Weather
  • Ocean conditions
  • Harbor conditions
  • Safety requirements
  • Mechanical issues
  • Government restrictions
  • Other circumstances beyond the reasonable control of Maui Adventure Cruises

A trip may be shortened or ended early when necessary for safety.

No Guarantee of Specific Experience

Maui Adventure Cruises does not guarantee:

  • A particular snorkel location
  • A particular destination
  • A particular species of marine life
  • A particular number of dolphins
  • A particular number of whales
  • Perfect weather
  • Calm ocean conditions
  • Underwater visibility
  • A particular route
  • A particular vessel, except where specifically confirmed
  • A particular fishing, snorkeling, or wildlife experience

Nature and ocean conditions are unpredictable, and the Captain retains discretion to modify the experience for safety.

Force Majeure

Maui Adventure Cruises shall not be responsible for failure or delay in providing services caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • Severe weather
  • Hurricanes or tropical storms
  • High winds or waves
  • Natural disasters
  • Harbor closures
  • Government restrictions
  • Public emergencies
  • Mechanical or infrastructure failures
  • Labor disruptions
  • Transportation disruptions
  • Marine emergencies
  • Other unforeseen circumstances

When such circumstances occur, Maui Adventure Cruises may postpone, reschedule, modify, or cancel the affected excursion.

Third-Party Services

Our website may contain links to or integrations with third-party services, including booking platforms, payment processors, travel companies, hotels, transportation providers, maps, social-media platforms, and other services.

Third-party services may have their own terms and privacy policies.

Maui Adventure Cruises does not control and is not responsible for the independent practices of third-party providers.

Website Use

Maui Adventure Cruises grants visitors a limited, non-exclusive, non-transferable license to access and use the website for personal and lawful purposes.

You may not:

  • Use the website for unlawful purposes
  • Attempt to gain unauthorized access
  • Interfere with website operation

Travel and Related Expenses

Maui Adventure Cruises is not responsible for expenses incurred by guests in connection with a canceled, delayed, shortened, or modified excursion.

  • Transportation
  • Meals
  • Other activities
  • Travel insurance
  • Personal expenses

Guests are encouraged to consider appropriate travel insurance for non-refundable travel expenses.

Limitation of Liability

To the maximum extent permitted by applicable law, Maui Adventure Cruises shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the website or participation in services, except where such limitation is prohibited by law.

Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited.

Participation in water activities may also be subject to the separate Release and Waiver accepted by each participant.

Security

Maui Adventure Cruises uses reasonable administrative, technical, and physical safeguards to protect information and payment transactions.

Payment-card information may be transmitted to authorized payment processors for processing.

Maui Adventure Cruises does not use reservation payment information for purposes unrelated to the applicable transaction.

No electronic system can be guaranteed to be completely secure.

If a provision of these Terms conflicts with a specific written agreement or waiver applicable to a particular excursion, the specific agreement may control to the extent permitted by law.

Severability

If any provision of these Terms is determined to be illegal, invalid, or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

No Partnership or Agency

Maui Adventure Cruises and its guests are independent parties.

Nothing in these Terms creates a partnership, joint venture, agency, franchise, employment, or other business relationship between Maui Adventure Cruises and a guest.

Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any action or proceeding to interpret or enforce these Terms shall be brought in an appropriate court in Maui County, Hawaii, unless applicable law requires otherwise.
